This document constitutes a legally binding agreement between Naitri Innovations Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at 160-A, Shyam Nagar Main, Sukhliya, Vijay Nagar, Indore, Madhya Pradesh, 452010, India (“Company”, “we”, “our”, or “us”) and the individual or entity (“User”, “you”, or “your”) accessing, downloading, installing, or using the Company’s mobile application, website, and related services (“App”).
By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App. If you are under 18 years of age, your parent or legal guardian must accept these Terms on your behalf.
1. DEFINITIONS
In these Terms, unless the context otherwise requires:
1.1 “Content” means all 3D models, animations, augmented reality (AR) and artificial intelligence (AI) powered interactive materials, quizzes, fun facts, voiceovers, puzzles, and other educational content made available through the App.
1.2 “Services” means the provision of access to the Content, learning tools, rankings, and related features.
1.3 “Subscription” means the paid access plans for the Services, as further described in Clause 4.
2. ELIGIBILITY
2.1 The App is designed for Students and Parents. School-level access may be provided in future on a conditional, non-exclusive basis.
2.2 Users below 18 years must have parental or guardian consent to use the App.
2.3 By registering, you confirm that the information you provide is accurate, current, and complete.
3. LICENCE AND INTELLECTUAL PROPERTY
3.1 The Company grants you a limited, non-exclusive, non-transferable, revocable licence to use the App solely for personal, non-commercial educational purposes, subject to these Terms.
3.2 All Content is for viewing only. You shall not download, reproduce, copy, modify, publish, distribute, transmit, sell, or create derivative works from the Content; remove, alter, or obscure any copyright, trademark, or proprietary notices on the Content; or use the Content for any commercial purpose without prior written consent from the Company.
3.3 All intellectual property rights in the App and Content are owned exclusively by the Company.
4. SUBSCRIPTION AND PAYMENT
4.1 The Company may offer an initial free trial period of three (3) to seven (7) days, based on User category.
4.2 Paid Subscription plans are available for one (1) month, three (3) months, six (6) months, nine (9) months, and one (1) year durations.
4.3 Subscriptions do not auto-renew. You must manually purchase a new Subscription after expiry.
4.4 All fees are payable in advance and are non-refundable, except as required by applicable law.
4.5 The Company reserves the right to revise pricing and features at any time, with reasonable notice to Users.
5. ACCOUNT USAGE RULES
5.1 Each Subscription permits login on only one device at a time.
5.2 You may not share your account or login credentials with any third party.
5.3 To access the App on another device, you must first log out from the currently logged-in device.
5.4 Any breach of this Clause may result in suspension or termination of your account without refund.
6. DATA COLLECTION AND PRIVACY
6.1 The Company collects personal data such as name, email address, phone number, school name, class, and related details for providing and improving the Services.
6.2 Cookies and similar technologies may be used for analytics, functionality, and enhancing user experience.
6.3 The Company does not sell personal data to third parties.
6.4 You may choose to share your progress, achievements, and rankings on social media or other platforms. Such sharing is voluntary and at your sole discretion.
6.5 Detailed information on data handling is provided in our Privacy Policy, which forms an integral part of these Terms.
7. GDPR COMPLIANCE
7.1 For Users located in the European Union, United Kingdom, or other jurisdictions with similar data protection laws, the Company processes personal data in accordance with the General Data Protection Regulation (GDPR).
7.2 You have the following rights: Right to Access, Right to Rectification, Right to Erasure, Right to Restrict Processing, Right to Data Portability, Right to Object.
7.3 Requests to exercise these rights may be made by emailing [insert support email].
7.4 For Users under 18, parental consent is required for data collection and processing.
8. LEADERBOARDS AND COMPETITIONS
8.1 The App may display rankings among students from the same school to encourage healthy competition.
8.2 Rankings will be based on performance in quizzes, activities, and other educational modules.
9. CUSTOMER SUPPORT
9.1 Support is available both within the App and via external communication channels specified in the App.
10. TERMINATION
10.1 The Company may suspend or terminate your access to the App at its discretion for any breach of these Terms or misuse of the Services.
10.2 Upon termination, your right to use the App shall cease immediately, and no refunds shall be given except as required by law.
11. DISCLAIMER AND LIMITATION OF LIABILITY
11.1 The App and Content are provided “as is” without warranties of any kind, express or implied.
11.2 To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, or punitive damages, loss of data, or loss of profits arising from your use of the App.
11.3 The Company shall not be responsible for technical issues, connectivity problems, or failures caused by third-party services.
12. AMENDMENTS
12.1 The Company reserves the right to amend these Terms at any time. The updated version will be posted within the App, and continued use after such posting constitutes acceptance of the updated Terms.
13. GOVERNING LAW AND JURISDICTION
13.1 These Terms shall be governed by and construed in accordance with the laws of India.
13.2 All disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Indore, Madhya Pradesh.
